The New Jersey Criminal Justice Process

Initial Complaint

Most criminal cases begin with the initial criminal complaint. This can be filed by the police or a citizen. A criminal complaint can lead to either a summons to appear in Court for municipal matters or an indictment and possibly an arrest warrant for more serious offenses.

First Appearance

A first appearance before the court must occur within 48 hours of an arrest. During this time, the judge may:

  • Set the conditions of a pretrial release
  • Order a pretrial detention

Criminal Justice Trials, and Sentencing

If your matter proceeds in Superior Court, a prosecutor must present the case to a grand jury to decide whether the Prosecutor has enough evidence.

If a grand jury returns an indictment, an arraignment will follow where the charges are read and the defendant pleads guilty or not guilty.

Certain defendants may qualify for Pretrial Intervention Program (PTI). Your defense lawyer can help determine the best course of action for you.

If a defendant pleads or is found guilty, the Court will hold a sentencing hearing.
